On Monday 1 July, the Undercover Policing Inquiry will start its Tranche 2 (Phase 1) hearings with three days of opening statements, followed by thirteen days of evidence hearings. The evidence hearings will be held in-person at the International Dispute Resolution Centre (IDRC) in London.

Opening statements

Opening statements will take place from Monday 1 July to Wednesday 3 July. The Inquiry will hear eleven separate oral opening statements specific to Phase 1 of Tranche 2, including a statement from David Barr KC Counsel to the Inquiry. Oral statements will be streamed, with 10-minutes delay, on YouTube. Recordings of the opening statements will remain available on the Inquiry website.

For the opening statement from David Barr KC Counsel to the Inquiry, the accompanying written statement will be published shortly after the oral statement has finished. For all other oral statements, the accompanying written statement will be published shortly before the oral statement begins.

Evidence hearings

The Tranche 2 (Phase 1) evidence hearings will take place from Monday 8 July to Friday 2 August. In this phase, seventeen witnesses are currently due to give oral evidence. The Inquiry will hear evidence from seven Special Demonstration Squad (SDS) officers deployed during the period between approximately 1983 to 1992. The Inquiry will also hear from ten civilian witnesses who represent groups that were infiltrated and women who were deceived.

In addition:

  • seven SDS officers, HN 12, HN 20, HN 67 and HN 82 HN 88, HN 33 and HN 95, will have summaries of their evidence read out.
  • further details of witness statements provided by civilians which will be read out will be confirmed in the Operational Note for the Tranche 2 (Phase 1) hearings next week.

Following proceedings

You can follow the evidence hearings either remotely through an audio-visual stream with a 10-minute delay on YouTube or in-person at the International Dispute Resolution Centre (IDRC) in central London.

An audio-only stream with a 10-minute delay will replace the audio-visual stream for the oral evidence of former SDS officer with real name anonymity and some of the civilian witnesses with real name anonymity, at their request. Five officers who have real name anonymity, HN 19, HN 25, HN 56, HN 65 and HN 90, and two civilian witnesses, “Bea” and “Jenny” will only be heard and their image will not be broadcast. In addition, “Jenny’s” voice will be modulated.

The YouTube streams will have automatic captions available and the capability to be paused and rewound.

The IDRC is open to core participants, the media and the general public. Those attending the venue will be able to see and hear all but three of the witnesses giving oral evidence in-person; following special measure applications, Francis Bennet, “Bea” and “Jenny” will give their evidence via video link.

Readouts of evidence summaries will also have an audio-visual stream with a 10-minute delay on YouTube.

A restriction order will be in place preventing any reporting on what is heard in the hearing room for 10 minutes.

Registration to attend the IDRC has now closed. If you have not registered but attend the hearing venue you may not be able to join the hearings in person as the Inquiry is expecting to be full on most days.

Draft transcripts will be published as soon as possible after the hearing day has finished.

Evidence disclosure

The hearing bundle for Phase 1 of Tranche 2 contains over 3,300 files.

The bundle includes written witness statements, intelligence reports and a timeline illustrating the start and end dates, as well as the ranks, of former SDS officers and those in the SDS supervisory chain of command for the period January 1978 – December 1996 inclusive.

The entire bundle, with the necessary redactions, will be published on the Inquiry website. Materials associated with a witness will be published as soon as they begin their oral evidence or have summaries of their evidence read out.

As soon as evidence is published, it will be available on the ‘Published evidence’ page, the page for the hearing day it was published on and, if applicable, the profile page of the associated witness.

This evidence will be in addition to over 3,400 files that have already been published on the Inquiry website as part of previous hearings.

The Hearing Bundle

The hearing bundle has been supplied to Core Participants and their Recognised Legal Representatives (RLRs) under a Restriction Order (RO) preventing the onward dissemination or publication of the material contained within it.

Restriction orders only apply to the disclosure or publication of evidence given to and held by the Inquiry. They cannot restrict the disclosure or publication of information held independently of the Inquiry.

Some of the documents and evidence presented during the hearings will be subject to further restriction, as a result of concerns raised by various non-state core participants (NSCPs) and their RLR’s regarding the private nature of some of the information contained within them. Applications were invited from NSCPs to apply for any restrictions on the further dissemination and/or publication of such information. This information has been protected in specific cases by an order restricting reporting (‘RRO’).

To comply with the Restriction Order and RROs, those with access to the hearing bundle should only quote from material published on the Inquiry’s website. When reporting on any live evidence from the hearing venue, the Inquiry will make specific reference to any reporting restrictions that may be in force on that day.
